4. Purposes of data processing

The scope and nature of the collection, processing and use of your data depend on whether you visit our website merely to access generally available information or to make use of services beyond this. In principle, we process your personal data in the course of our business activities for pre-contractual or contractual purposes. In addition, the pursuit of our legitimate interests, your consent or compliance with legal requirements may also constitute the basis for our data processing. We provide information on the specific purposes of data processing in the sections below.

5. Legal basis for data processing

We process your personal data on the following legal bases:
  • to fulfil pre-contractual or contractual obligations (Article 6(1)(b) of the GDPR)
  • on the basis of your consent (Article 6(1)(a) of the GDPR)
  • as part of a balancing of interests (Article 6(1)(f) of the GDPR)
  • on the basis of legal requirements (Article 6(1)(c) of the GDPR)
We will inform you of the specific legal bases for data processing in connection with each instance of processing.

6. Right to object

Where, following a balancing of interests, we process your personal data on the basis of our overriding legitimate interest (legal basis: Article 6(1)(f) of the GDPR), you have the right to object to this processing at any time on grounds relating to your particular situation. If you exercise your right to object, we will cease processing the data in question. However, we reserve the right to continue processing (with the exception of direct marketing; in this case, we will comply with your objection immediately) if we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves to establish, exercise or defend legal claims. This does not affect any further rights you may have as a data subject.

7. Use of our website for information purposes

When using our website purely for information purposes, you are generally not required to provide any personal data. Instead, when you visit our website, we only collect the data that your web browser automatically transmits to us, such as:

The legal basis for this processing is our legitimate interest pursuant to Article 6(1)(f) of the GDPR. Our legitimate interest lies in the proper operation of our website. On our website, you have the option to apply to us online via a form, either as a speculative application or in response to a specific job vacancy. Personal data that you enter into our form is securely encrypted using state-of-the-art technology during transmission.

We process the personal data you provide via the form, including your application documents, on the basis of the consent you have given by confirming this before submitting your application. Applicants may also submit their applications to us via email. However, please note that emails sent over the internet are generally not encrypted. As a rule, whilst emails are encrypted during transmission, they are not encrypted on the servers from which they are sent and received. We are therefore unable to accept any responsibility for the transmission of the application between the sender and our server.

11. Newsletter

You can subscribe to our newsletter via our website. We use the CleverReach service to send out newsletters and to measure the success of our marketing activities. The provider is CleverReach GmbH & Co. KG, CRASH Building, Schafjückenweg 2, 26180 Rastede. We have entered into a data processing agreement with CleverReach. For further details, please refer to CleverReach’s privacy policy at: https://www.cleverreach.com/de-de/datenschutz/.

When you subscribe to our newsletter, your email address and your consent are collected; the purpose is to be able to send you the newsletter and to document our authorisation to do so. The legal basis for the processing is Article 6(1)(a) of the GDPR. You may withdraw this consent at any time with future effect by unsubscribing from the newsletter; we provide a link for this purpose in every newsletter message. The lawfulness of any data processing that has already taken place remains unaffected by the withdrawal.

In addition, the following data is collected for the purpose of logging the registration process: your IP address, as well as the date and time of registration. This logging is carried out on the basis of our legitimate interests pursuant to Article 6(1)(f) of the GDPR and serves as evidence of your consent to receive the newsletter.

Our newsletters also enable us to analyse your behaviour (e.g. opens, clicks). The data you have provided to us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from both our servers and the servers of CleverReach following unsubscription. Data stored by us for other purposes (e.g. email address in your customer account) remains unaffected by this.

12. Security

We have secured our website and other systems against the loss, destruction, unauthorised access, alteration or disclosure of your data by unauthorised persons through technical and organisational measures. In particular, the personal data you provide via the contact form is transmitted in encrypted form. We use the TLS 1.3 (Transport Layer Security) encryption system for this purpose.

13. Cookies and similar technologies

We use cookies or similar technologies for various purposes, e.g. to ensure the functionality, security and user-friendliness of our online services, as well as to analyse visitor traffic.

Cookies are small text files that are stored on your computer when you visit our website. Similar technologies include so-called web storage techniques (also known as ‘local data’ and ‘local storage’); these store data locally in your browser’s memory (known as the ‘cache’). For the sake of clarity, we have grouped cookies and similar technologies together under the term ‘cookie’ in the following.

We use cookies in accordance with the relevant legal provisions. We therefore obtain prior consent from users, unless this is not required by law.

If users give their consent, the legal basis for the processing of their data is the consent given in accordance with Article 6(1)(a) of the GDPR. This revocable consent is clearly communicated to users and includes information on the specific use of cookies. Further information on individual cookies or similar technologies and their purpose can be found in our privacy settings (open cookie settings).

In particular, consent is not required where the storage and retrieval of information – including cookies – is strictly necessary to provide users with a digital service (i.e. our online offering) that they have expressly requested. In these cases, the legal basis for the processing of your data is the fulfilment of our contractual obligations under Article 6(1)(b) of the GDPR, compliance with legal obligations under Article 6(1)(c) of the GDPR, or our legitimate interest (e.g. in the business-related and secure operation of our online service and in improving its usability) under Article 6(1)(f) of the GDPR. Further information on the individual cookies and their purpose can be found in our privacy settings (open cookie settings).

If you wish, you can delete the cookies at any time. However, this may mean that certain functions are no longer available to you. To delete the cookies, please refer to your browser’s help function or change your settings in the privacy settings (open cookie settings).

Technically necessary ‘comparable technologies’ (session storage)

To control our consent/tag manager, technically necessary information is stored in the browser’ssession storage. This serves solely to ensure the correct execution of consent and placeholder logic (e.g. assigning CSS selectors to categories) and is carried out without user identification, profiling or cross-page recognition. The data is deleted when the browser tab is closed. Legal basis: Section 25(2)(2) of the TDDDG and Article 6(1)(f) of the GDPR (legitimate interest in a legally compliant, functioning consent procedure).

13.1 Shopware

This website uses the Shopware cookie consent tool provided by shopware AG, Ebbinghoff 10, 48624 Schöppingen. The purpose of this processing is to obtain and document consent for the storage of certain cookies on your device or for the use of certain technologies, as well as to technically enable the withdrawal of consent that has been given. The service is hosted locally on our server. No data is passed on to third parties in this process. Shopware stores cookies in your browser so that it can associate the consents you have given – or any withdrawal thereof – with your account.

The legal basis for the processing of the data is Section 25(2)(2) of the TDDDG and Article 6(1)(c) and (f) of the GDPR to fulfil our legal obligation to obtain consent to the processing of personal data in accordance with the provisions of the applicable data protection laws and to document this consent. The data collected in this way will be stored until you request its deletion, delete the Shopware cookies yourself, or the purpose for storing the data no longer applies. Mandatory statutory retention obligations remain unaffected. Further information can be found in the privacy policy at: https://www.shopware.com/de/datenschutz/.

14. Web analytics

etracker

The provider of this website uses services provided by etracker GmbH, based in Hamburg, Germany (www.etracker.com), to analyse usage data. The etracker consent manager module is used for consent management. Script codes from other tools can be integrated via the etracker Tag Manager module. When combined, the etracker Tag Manager and Consent Manager enable the control of specific cookies and services, provided the relevant consent has been given. Even if statistical cookies are rejected, usage data is still collected in accordance with the legal requirements of the EU General Data Protection Regulation (EU GDPR) and the Telecommunications and Digital Services Data Protection Act (TDDDG). Data processing is carried out on the basis of the legal provisions of Article 6(1)(f) (legitimate interest) of the EU GDPR. Our legitimate interest, within the meaning of the EU GDPR, is to optimise our online offering and to ensure the legally compliant integration and management of further services on our website. Where the relevant consent has been given, the use of other technologies is based on Article 6(1)(a) of the EU GDPR. Consent may be withdrawn at any time.

The web analytics data generated by etracker is processed and stored exclusively in Germany by etracker on behalf of the provider of this website and is therefore subject to strict German and European data protection laws and standards. etracker has been independently audited and certified in this regard and has been awarded the ePrivacyseal data protection seal of approval. As the privacy of our visitors is important to us, any data that could potentially be linked to an individual, such as the IP address, login or device identifiers, is anonymised or pseudonymised at the earliest opportunity. The data is not used for any other purpose, combined with other data or disclosed to third parties.

You can object to the data processing described above at any time by clicking on the slider. Objecting will not result in any adverse consequences. If no slider is displayed, data collection has already been prevented by other blocking measures.

You can object to audience measurement by etracker here: Disable tracking.

Further information on data protection at etracker can be found here.

We maintain publicly accessible profiles on social media platforms. You can find a list of the specific social media platforms we use below.

Social networks can analyse your user behaviour in detail when you visit their website or a website containing integrated social media content (e.g. ‘Like’ buttons or advertising banners). Visiting our social media pages triggers numerous data processing operations relevant to data protection.

Legal basis
Our social media profiles are intended to ensure an informative online presence. This constitutes a legitimate interest within the meaning of Article 6(1)(f) of the GDPR. Where necessary, the legal basis is also Article 6(1)(a) of the GDPR.

Data controller and exercising your rights
When you visit one of our social media pages, we are jointly responsible with the operator of the social media platform for the data processing operations triggered by that visit. You may, in principle, exercise your rights (right of access, rectification, erasure, restriction of processing, data portability and the right to lodge a complaint) both with us and with the operator of the relevant social media portal. Please note that, despite this joint responsibility, we do not have complete control over the data processing operations carried out by the social media platforms.

Retention period
Data collected directly by us via our social media presence will be deleted from our systems as soon as the purpose for which it was stored no longer applies, you request its deletion, or you withdraw your consent. Stored cookies remain on your device until you delete them. Mandatory legal provisions remain unaffected.
